What is Statutory Pay?

Statutory pay is UK government-mandated pay that eligible employees receive during certain life events. There are several types of statutory pay, each with specific eligibility criteria and payment rates.

Statutory pay is paid by your employer (who can claim it back from the government) and is subject to National Insurance and income tax deductions. To qualify, you must meet certain employment and earnings criteria.

Types of Statutory Pay

Statutory Maternity Pay (SMP)

Statutory Paternity Pay (SPP)

Paid for 1 or 2 weeks. Rate: £184.03 per week (or 90% of average weekly earnings if lower).

Statutory Adoption Pay (SAP)

Paid for up to 39 weeks. Rate: £184.03 per week (or 90% of average weekly earnings if lower).

Statutory Shared Parental Pay (ShPP)

Up to 50 weeks can be shared between parents. Rate: £184.03 per week (or 90% of average weekly earnings if lower).

Eligibility

You must earn at least £123 per week (Lower Earnings Limit) and have worked for your employer for at least 26 weeks by the qualifying week.

Example 1: Statutory Maternity Pay

Average weekly earnings: £300. First 6 weeks: £270 per week (90% of £300). Remaining 33 weeks: £184.03 per week. Total: £270 × 6 + £184.03 × 33 = £7,872.99 over 39 weeks.

Example 2: Statutory Paternity Pay

Average weekly earnings: £500. Weekly rate: £184.03 (standard rate as it's lower than 90% of £500). Total for 2 weeks: £368.06.

Example 3: Statutory Adoption Pay

Average weekly earnings: £150. Weekly rate: £135 (90% of £150 as it's lower than standard rate). Total for 39 weeks: £5,265.

How is average weekly earnings calculated?

Average weekly earnings are calculated based on your earnings in the 8 weeks (or 2 months) before the qualifying week. This includes your normal salary, bonuses, and overtime, but excludes certain payments.

Do I pay tax on statutory pay?
